Re: Macrobiotic child needs a new home!
The first time I had read the post I didn't really think about it, but seeing it again I began to realize just how much could be below the surface. If the mother has all her rights, and while she's out partying they send the child to another person's home to live, and don't tell her beforehand and have her agreement, its kidnapping. Even if it was with the best intentions the law sees it as kidnapping. Doing so across state lines I think even makes it a felony.
If the grandma has custody for the sake of dealing with doctors, schools, etc, but the mother still has full visiting rights and such, and the child is removed suddenly and she was not knowing about it, there could also be legal repercussions because it would infringe on her rights she does retain.
If the mother has run off, and the Granma is taking care of a child, the law will vary by state but I imagine in general the mother would have to have been listed as missing and then I'm sure other legal issues would have to be decided on by a judge to grant custody to the Granma due to what would be seen as negligence on the mother's behalf for ditching them all.
There's just so much that is unsaid about the actual situation that could exist, and so many dangers in just moving a child around to someone who doesn't have legal rights to raising him.
